Sitter Agreement — Pennsylvania
Family Meeting Sitter Services Agreement
For families served by Jovie of Pennsylvania (Pittsburgh area). Please review the full agreement below before submitting a backup care request.
This Sitter Agreement (“Agreement”) is entered into between the d/b/a Jovie of Pennsylvania location, an independently owned and operated Jovie® franchise serving the Pittsburgh area, and the Parent/Guardian (“You”) regarding the children identified on the Family Information Form (the “Child(ren)”).
1. Engagement
Jovie provides temporary sitter services (“Sitter Services”) under the brand “Jovie.” All sitters are screened, interviewed by Jovie staff, and have passed the Jovie Premier Background and reference checks. Jovie will attempt to secure a sitter for a care event as requested but does not guarantee that a sitter will be available. If You request care at a different location while traveling, sitters may be provided by another Jovie® franchise at its applicable rates, and these same terms and conditions will apply. You are responsible for keeping Jovie and the sitter informed of the needs of the Child(ren), including instructions for any medication, and we will respond to those needs consistent with Jovie’s policies and guidelines.
Jovie must have a signed Sitter Services Agreement, Family Information Form, and a completed Payment Authorization Form prior to start of care. A child must be identified on the Family Information Form to receive services. A minimum hour block is required for a sitter to be scheduled. Child(ren) will be released only to a Parent/Guardian, an adult listed on the Family Information Form, or another adult who is specifically authorized in writing by a Parent/Guardian. You are required to provide any applicable restraining orders, custody orders, or other legal documents to Jovie before a sitter is dispatched.
2. Fees
Sitter Services are charged at a rate of $32 to $36 per hour, depending on the details of the care (including the number, ages, and needs of the children, sitter qualifications, and the requested date and time). An overtime rate of 1.5 times the hourly rate is charged when the sitter reaches the overtime threshold under applicable law and on Federal holidays. Parking fees may apply depending on the care location. The rate range is subject to change on thirty (30) days’ notice. Services are billed on a bi-weekly basis and charged to your account electronically and automatically. Jovie may decline service requests if balances are outstanding or payment has been declined by your bank.
Any enrollment and/or annual renewal fees, if applicable, will be disclosed to You in writing before they are charged.
3. Cancellations
You may cancel service at your discretion; however, notice must be given to Jovie no less than 24 hours prior to the start of the scheduled service or You will be charged for care reflected in your confirmation.
4. Employment and Employment Claims
All sitters providing services under this Agreement are employees of Jovie, which is responsible for the payment and reporting of all wages, employment taxes, Workers’ Compensation coverage, and other legal requirements arising from the employer/employee relationship. Jovie hereby releases and agrees to indemnify, defend, and hold Parent/Guardian harmless from and against all liability, losses, claims, damages, and expenses (including attorney’s fees) which Parent/Guardian may incur as a result of any claim by a sitter for nonpayment of wages, benefits, vacation or other pay, unemployment, or workers’ compensation coverage.

Jovie does not discriminate on the basis of race, gender, gender identity, color, sex, sexual orientation, religion, national origin, age, disability status, veteran status, or any other factor that is not relevant to the provision of Sitter Services.
5. Release and Indemnity
In exchange for Jovie providing the services, by signing the Agreement You, on behalf of yourself, your family, and your minor Child(ren), hereby release and agree to indemnify, defend, and hold harmless Jovie, its affiliates, franchisor, subcontracted franchisees, and parent companies, and their officers, directors, sitters, employees, and agents (the “Releasees”) for any and all liability, losses, claims, damages, thefts of or damage to personal property, personal injuries (including death), costs, or expenses of any nature (“Claims”) arising from or related to the negligence of the Releasees or the Sitter Services, including but not limited to Claims arising from Your requests, authorizations, and activities recited in Sections 7 through 9 below. This release shall not apply to the extent that such damage or injury arises out of a sitter’s or Releasee’s gross negligence or willful misconduct.
6. Insurance
Parent/Guardian is responsible for having adequate health, accident, disability, personal property, theft, auto, and other insurance to cover any costs, expenses, injuries, or losses associated with or suffered as a result of the Sitter Services. Jovie does not provide any insurance coverage to Parent/Guardian or Child(ren).
7. Personal Information and Medical Authorization
Medical, family, and other personal information may be shared within Jovie’s system as needed to administer the program and deliver services. Parent/Guardian authorizes Jovie and its sitters to take reasonable, necessary steps in the best interest of a Child who becomes sick, has an accident, or requires medical attention during care, including without limitation administering first aid, calling 911, and/or transporting the Child for emergency medical treatment.
Medication administration requires Parent/Guardian written approval and written instructions provided to the sitter prior to the care event, including the medication name, dosage, timing, and any other relevant information. Instructions must be consistent with those on the prescription or packaging. By initialing the medication authorization on your Family Information Form, Parent/Guardian requests and authorizes the administration of medication(s) to Child(ren), agrees to be fully responsible therefore, and agrees that Section 5 above shall apply.
8. Limitations on Driving and Use of Personal Vehicles
Due to the inherent risks, Jovie discourages the transportation of Child(ren) in a motor vehicle during a care event. If You still request transportation, Jovie recommends that a Parent’s/Guardian’s vehicle is used for the protection of both the sitter and the Child(ren), to assure the vehicle satisfies all safety requirements, that adequate insurance is in place, and that car seats have been properly installed. Jovie makes no representation as to the suitability of any sitter or any sitter’s vehicle for this purpose.
Sitters are prohibited from transporting any child who is not wearing the proper restraint or using a car seat. By initialing the transportation authorization on your Family Information Form, You request and authorize the transportation of Your Child(ren) in a motor vehicle, agree to be fully responsible therefore, and agree that Section 5 above shall apply.
9. Swimming
Sitters are not certified lifeguards. Jovie recommends swimming only under the supervision of a lifeguard or as part of an organized swimming lesson. You take full responsibility if You authorize Your Child(ren) to go swimming under these or any other circumstances. By initialing the swim authorization on your Family Information Form, You request and authorize Your Child(ren) to participate in swim activities, agree to be fully responsible therefore, and agree that Section 5 above shall apply.
10. Non-Solicitation of Employees
You may not solicit, hire, or utilize (whether directly or indirectly, on behalf of yourself or others) any Jovie sitter introduced to You or who provided services to You during or for one (1) year after a care event, unless Jovie gives written permission and You have paid an employment placement fee disclosed to You in writing.
11. Term and Termination
This Agreement commences upon the Effective Date and will continue in full force and effect so long as You use Jovie services, or until terminated by either party upon written notice. Sections 2, 4, 5, 7, 8, 9, and 10 shall survive any termination of this Agreement. Jovie reserves the right to decline to provide services to a family who demonstrates behavior that is inappropriate, abusive, disrespectful, or threatening to others, who is disruptive to our operations, or who refuses to comply with our policies and procedures. A family is expected to provide a clean, healthy, and safe environment for both children and sitters.
12. General
Any breach or controversy arising out of, or related to, this Agreement or the breach thereof shall be resolved under the laws of the State of Pennsylvania. If any term or provision of this Agreement is held to be illegal, unenforceable, or in conflict with any law governing it, the validity of the remaining portions of the Agreement shall not be affected and shall remain in full force and effect.
